All orders are delivered curbside with a lift gate unless otherwise requested by the client in writing prior to shipping. Any additional services, such as inside delivery, removal of packing material, or other delivery-related services, must be requested in writing before shipping and will incur additional costs to the client.
For inside deliveries, clients are responsible for verifying building access and entry measurements, including entryways, stairways, and/or elevators, to ensure the units will fit into their final destination upon delivery. Any additional costs incurred for delivery, including walkups, extra time for unusual circumstances, or redeliveries, will be the client's responsibility. Inside delivery availability is not guaranteed for all locations.
It is the client's responsibility to inspect the goods upon delivery and report any damages on the bill of lading. If there is visible damage, the client must immediately check the content at the time of delivery, take pictures, note any damage on the delivery bill, and notify Gamma & Bross USA within one business day. If the products are severely damaged, the client may refuse the delivery.
If there is no visible damage to the crates or boxes, and the client is unable to check the content of the crates or boxes at the time of delivery, the delivery bill must be signed "with reserve," stating that possible remarks may be made later after duly checked.
The client must notify Gamma & Bross USA in writing within five calendar days after receipt of the products of any damaged goods, shipment shortages, defects, or any other problems with the goods. Failure to do so will constitute conclusive proof that the products were received without error, fault, or damage.
In case of issues with items, Gamma & Bross USA reserves the right to determine the appropriate solution.
Should the client decide to schedule a pickup from Gamma & Bross USA’s distribution centers (Brooklyn, NY, or Jamaica, NY), inspection should be made at the time of receiving the order. Gamma & Bross USA reserves the right to charge an additional $20 per crate or pallet loading fee.
For undeliverable address packages that return to us or if the purchaser refuses to accept goods ordered, these orders are subject to a 50% minimum restocking fee plus any storage and freight charges incurred. Items requiring a color selection or special custom products are subject to a 100% restocking fee plus any storage and freight charges incurred.
Storage
Once units have cleared customs and have been delivered to Gamma & Bross USA’s distribution center, the orders are prepared and scheduled for delivery. Clients are notified of shipment scheduling and tracking information if applicable. If the client or the final destination is not available for delivery within seven business days of the units’ arrival, Gamma & Bross USA reserves the right to charge a $0.50 per square foot per day storage fee.
Delays in the receipt of the balance will delay shipment, and storage fees will be applied starting seven business days after goods are ready for delivery. In the event of default in the obligation to pay an outstanding balance, the client shall be liable for the costs of cancellation, attorney's fees, disbursements, court costs, late charges, freight charges incurred, storage fees, and any other charges relating to the order.
Delays
Please note that delays due to unexpected events in manufacturing, shipping, or customs operations may occur. We regret to inform you that clients will not be entitled to any form of reparations in such cases. Any delivery dates specified in the order are considered estimates only. GAMMA & BROSS USA shall not be liable for any loss of use or for any direct, indirect, or consequential damages resulting from delay, regardless of the reason(s). By placing an order, clients agree that the time of delivery of the products is not of the essence and waive any and all claims arising from any delay in delivery, including, but not limited to, any claims for direct, incidental, consequential, or other damages.
